This Authorization is essential for you to receive rewards for pharmacy services, such as vaccinations or prescription refills. It allows us to inform you about rewards programs and other benefits we offer. Without your Authorization, we may not be able to provide these rewards or benefits.
What this authorization means
By giving us this HIPAA Marketing Authorization, you permit us to use your protected health information (PHI)—including your phone number and email—to send you personalized offers. This includes rewards, deals, and discounts, which are considered marketing under the law, so we need your consent to provide these benefits.
What you are authorizing
I authorize my Albertsons pharmacy to use and disclose my information, including my name, age, demographic details, phone number, email address, and all prescription and immunization data, to:

<li>Offer information, services, and products related to health and wellness.</li>
<li>Send health-related messages about treatment options or other health-related products or services, including invitations to participate in adherence programs, educational information about prescriptions, availability of additional vaccines (e.g., shingles, pneumococcal conjugate, seasonal influenza, routine childhood vaccinations), disease screening services, and programs to manage health conditions (e.g., asthma, diabetes, heart disease).</li>
<li>Communicate with me about its products or services and evaluate the effectiveness of any communication program.</li>
</ul>
Additional information
<ul>
<li>Communications under this Authorization may be made via the mobile app, text message, email, social media, and/or direct mail.</li>
<li>Albertsons pharmacy may receive compensation for sharing offers and helpful communications with you or disclosing such information.</li>
<li>Any information disclosed under this Authorization may be subject to re-disclosure by the recipient and may no longer be protected by HIPAA.</li>
<li>Granting Authorization is voluntary. Your treatment or eligibility for health benefits will not be affected by your decision, and you will still be able to receive Albertsons pharmacy services.</li>

Duration and Revocation
This Authorization is valid until revoked or three (3) years from the date signed, or as required by state law, whichever occurs first. You may revoke this Authorization at any time by:

Revoking this Authorization will not affect any uses or disclosures made by Albertsons Pharmacy before the revocation. You can obtain a copy of this HIPAA Authorization on your “Privacy Center” page in your Sincerely Health account.

3.&nbsp; We Grant You a License to Access and Use the App, but Only for Informational and Non-Commercial Purposes.
Notwithstanding anything to the contrary in Section 3 of the General Terms of Use, we grant you a personal, non-exclusive, limited license to access and use the App (excluding, for clarity, the right to download, print, store, or transfer portions of the App or any App Content (as defined below)), provided that: (i) you access or use the App solely for your own personal, non-commercial use and solely in North America; and (ii) you comply at all times with the Terms.&nbsp; No right, title or interest in and to the App or any App Content is transferred to you other than the limited license to access and use the App set forth in this Section 3.
4.&nbsp; You May Not Engage in Restricted Activities.&nbsp;&nbsp;
Use of the App or any information, data, materials, text, graphics, images, and other content available on the App, including Third Party Content, Medical Content and Nutritional Content (collectively, “App Content”) other than as specifically permitted in these Health and Wellness Terms is expressly prohibited.&nbsp; Without limiting any of your obligations set forth in the General Terms of Use, except as expressly permitted in these Health and Wellness Terms, you will not, in whole or in part, engage in any of the restricted activities set forth in this Section 4.
a. No Use as a Diagnostic Tool.&nbsp; You will not use or refer to the App as a diagnostic tool, or apply or refer to use of the App or App Content for medical or similar use.
b. No Violation of Our Proprietary Rights.&nbsp; You will not use the App to violate our proprietary rights.&nbsp; Without limitation, you will not:
i. Use or copy any App Content or any parts, features, functions, or graphics included in the App, or the user interface of the App, without our prior written consent;
ii. Create derivative works of, modify, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of, trade secret or know-how of the App or App Content (except to the extent that applicable laws and regulations prohibit reverse engineering restrictions, and then only as permitted by such laws);
iii. Remove, obscure, alter, or move, as applicable, our and our licensors’ proprietary notices;
iv. Disclose any information regarding the functionality or performance of the App to any third party without our consent;
v. Adapt, alter, extend, modify or vary the App (in whole or in part) in any way or permit the App or any App Content (in each case, in whole or in part) to be combined with or to become incorporated in any other program other than the App, without our prior written consent; or
vi. Use App Content or generally data provided by functionalities of the App for the development of derived models, including by deriving an approximate health score model or risk engine model for independent use (e.g., on a stand-alone basis) by you or third parties.
c. No Violation of Third Party Rights.&nbsp; You will not use the App to violate the rights of any third party.&nbsp; Without limitation, you will not:
i. Store or transmit infringing, libelous, or otherwise unlawful or tortious material on the App; or
ii. Store or transmit material on the App in violation of third-party privacy rights.
d. No Redistribution.&nbsp; You will not make the App available to any third party.&nbsp; Without limitation, you will not:
i. Sell, resell, license, sublicense, distribute, transfer, assign, distribute, display, broadcast, disclose, rent, lease or otherwise commercially exploit or make the App, or any portion thereof, available to any third party in any manner; or
ii. Transmit, rent, sell, lease, offer on a pay per play or pay per transaction basis, distribute for money or any other consideration, or commercially exploit the App or App Content in any other manner or through any medium whatsoever with any third parties.
&nbsp;
e. No Compromises to Security or Integrity of the App.&nbsp; You will not compromise the security or integrity of the App.&nbsp; Without limitation, you will not:
i. Store or transmit malware or malicious code on the App;
ii. Disrupt, interfere with or adversely impact the access to or use of the App by us or any third party;
iii. Modify, circumvent, interfere with, tamper with, disrupt, or repair any element of the App or its access control features, the integrity of the App, or the integrity of any third-party data contained in the App;
iv. Attempt to gain unauthorized access to the App or its related systems or networks; or
v. Disclose your access credentials to any third party without consulting and without our prior consent.
f. Other Prohibited Activities.&nbsp; You will not:
i. Access or use the App for the benefit of any third party;
ii. Access or use the App in a way to avoid incurring fees or exceeding usage limits or quotas or to circumvent or render inoperative any usage restriction features contained in the App;
iii. Retrieve or disclose App Content other than by normal user interaction in the App; or
iv. Use any automated functionality to retrieve or index any portion of the App Content or of our or our licensors’ other data, products or services for any unauthorized purpose.
5.&nbsp; Change of Access Credentials.
Without limiting any provisions of the General Terms of Use, we reserve the right to change your access credentials at any time without prior notice to you if we believe that such change is necessary for security reasons.
6.&nbsp; Disclaimer.
Without limiting Sections 4 and 20 of the General Terms of Use, or any other provisions of the General Terms of Use, you acknowledge and agree that (a) you use the App at your own risk and Company does not assume (and expressly disclaims) responsibility for the results of your access to or use of the App, (b) the App is not, and cannot be used as, a diagnostic tool and should not be applied for clinical, medical or similar uses, (c) the App is not considered to be a medical device and the App does not provide anamnesis, diagnosis, prediction, prognosis, or clinical or medical recommendations, (d) any App Content provided to you as a result of your access to or use of the App (including any product recommendations) is based on data or information that you provide to us and information that we obtain from product packaging and independent third-party sources, (e) we do not conduct, and are not responsible for conducting any research relating to, nor do we make any representations and warranties relating to, the accuracy, effectiveness, suitability, or any other qualities or features associated with any App Content, (f) we are not responsible or liable for any harm to your systems, loss of data, or other harm resulting from your access to or use of the App, or the failure to store or transmit, any App Content or any data or information that you provide to us, (g) the App does not provide medical advice, does not provide a clinical evaluation or your health, is not reviewed by a medical professional, and is not a replacement for the advice of a qualified healthcare professional, (h) the App is designed to supplement, not replace, the methods you use to maintain a healthy lifestyle, (i) you remain at all times solely responsible, in consultation with your healthcare provider, for managing your health and lifestyle, (j) before making any changes to your lifestyle habits in connection with your access to or use of the App, you will consult with your professional healthcare provider to ensure such changes are safe and appropriate for your health, and (k) no App Content or other information, whether oral or written, obtained by you from or through the App will create any warranty not expressly stated in these Health and Wellness Terms.
7.&nbsp; Our Liability is Limited.
WITHOUT LIMITING SECTION 21 OF THE GENERAL TERMS OF USE, OR ANY OTHER PROVISION OF THE GENERAL TERMS OF USE, TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, COMPANY IS NOT LIABLE FOR (A) ANY DAMAGE OR INJURY, INCLUDING ANY DEATH, PAIN OR SUFFERING, OR PSYCHOLOGICAL OR BODILY INJURY THAT YOU SUFFER, OR THAT YOU CAUSE TO ANY THIRD PARTY, IN CONNECTION WITH YOUR USE OF THE APP OR ANY ACTIVITY THAT YOU TAKE OR FAIL TO TAKE IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE APP, OR (B) ANY DAMAGES THAT ARE THE RESULT OF (I) IMPROPER ACCESS TO OR USE OF THE APP OR APP CONTENT, (II) YOUR FAILURE TO COMPLY WITH THE TERMS, OR (III) YOUR FAILURE TO COMPLY WITH APPLICABLE LAWS AND REGULATIONS.

In interpreting these Health and Wellness Terms, the conjunction “or” will be understood in its inclusive sense (and/or), and the words “include”, “includes” and “including” will be deemed to be followed with the phrase “without limitation”.
